Health Guarantee/Purchase agreement

I,                                     (from here on referred to as the breeder) have made every effort to provide you the purchaser with a healthy puppy that is guaranteed to be in good health at the time purchaser takes ownership. I guarantee that all vaccinations and dewormings are current at the time of purchase.
For the protection of both parties the puppy must be examined by a licensed veterinarian at the purchasers own expense within 3 business days of taking ownership of the puppy. Failure to do so renders the health and genetic guarantee portion of this agreement null and void. If this puppy is found to have a life threatening hereditary /congenital defect or any major health problem at this time the purchaser has one of 3 options,

1: return the puppy immediately for a full refund of the purchase price,

2: return the puppy immediately and receive a replacement puppy of equal value (within 12 months),

3: keep the puppy with no replacement or refund,

provided that the breeder is notified with in 24 hrs of the vet exam and provides the breeder with a signed letter from a licensed veterinarian on an official letterhead stating the defect or health problem. The purchaser must return the puppy along with all papers within 4 business days of ownership of the puppy.

I, the breeder, am not responsible for any bills acquired by you, the purchaser, after the date of purchase.
Certain disorders may be caused by environmental factors, including but not limited to, the following: coccidia, giardia, kennel cough, cancer, demodectic mange, scabies, allergies and other autoimmune system disorders, and hypoglycemia, and these are are not covered in this guarantee. This guarantee does not include injuries, fleas, mites, or any other intestinal worm/parasites, as they are common in puppies. Our puppies are vet checked prior to leaving our home. This guarantee does not include uneven bites, undescended testicles, class 1 or 2 murmur, inguinal or umbilical hernias. I the breeder will not be responsible for Parvo, Distemper or Cornona Virus after 72 hrs after sale, as these are highly contagious diseases and they can be contracted immediately after leaving my home. I the breeder will not be responsible for any illness or health problem, which are diagnosed after this time period, except where specifically stated in this contract.
This puppy is being sold as a companion not as breeding dog. This puppy must be spayed/neutered by 9 months of age. If this puppy has not been spayed/neutered by 6 months of age the health and genetic guarantee portion of this contract becomes null and void. This dog may not be bred unless you have received written consent from breeder and have paid the extra fee associated for breeding rights (which is a separate contract). Any offspring produced by this dog without written consent from breeder is the sole property of the breeder. If any offspring is produced and or sold without breeders written consent fines of $3000 for breeding without breeding rights per litter will be paid to breeder.
Your puppy is guaranteed for 1 years from the date of birth against any other life threatening congenital defects. If with in that time a life threatening congenital defect is attested to by two non-associated licensed veterinarians and the reason is congenital, the breeder will either pay vet bill up to but not beyond the purchase price of the puppy, or replace the puppy with another of the same breed and quality and price if the breeders veterinarian agrees with the required reports from two non-associated licensed veterinarians. The breeder must be notified at the onset of the problem,in writing, with a report from two non-associated veterinarians. The replacement puppy will be subject to availability (within 12 months) and the breeder does not guarantee colour, sex, or coat type of the replacement puppy. Cash refunds will not be given after the initial 3 day period and refunds are only given if the puppy has seen a licensed veterinarian and they send a written statement declaring the puppy has a life threatening congenital defect within the 3 day stated period and the puppy is returned immediately to the breeder.
In the unlikely event of the death of this puppy in the first year from the date of birth, due to congenital defect , a statement from a licensed veterinarian confirming such an event and cause is required before any action will be taken by the breeder. If cause is unknown a autopsy is required at the owners expense. The breeder will not be responsible for any veterinary or health bills associated with such an event.
Your puppy has been on a vaccination and de-woming schedule while in the breeders care and are up to date. Official records of this have been provided in the purchaser's puppy packet. I encourage you to take this health record to your veterinarian, it is important to continue with the vaccination and de-worming schedule after taking ownership of your new puppy. You the purchaser, agree to insure your puppy's good health and to keep this guarantee in effect by taking good care of the puppy a providing good food and water, housing, regular grooming, and good medical care. As a responsible puppy owner/purchaser you must provide your puppy with routine preventative care and all immunizations, administer monthly heart worm preventatives and annual physical by a licensed veterinarian. Failure to do so will make the health and genetic guarantee portion of this agreement null and void.
You the purchaser agree that this puppy/dog will never be surrender to an animal shelter or rescue, abandoned, euthanized, or resold due to inability/willingness to care for the puppy/dog. In the event that at any point in the puppy's/dog's life the purchaser is no longer able/willing to care for the puppy/dog resulting in the puppy/dog needing to be re-homed the purchaser agrees to give the breeder first right of refusal to return the puppy/dog to the breeders care. No refund will be given to purchaser in such an event.
The health and genetic guarantee portion of this contract is valid only for the original purchaser of this puppy as stated at the beginning of the contract. If this puppy/dog is transferred to another owner at any time, the health and genetic portion of this guarantee becomes null and void. The health and genetic guarantee portion of this contract is null and void if any of the terms are not fulfilled.
The breeder makes no guarantees, expressed or implied, under this contract except as stated above. This guarantee must be signed at the time of purchase and both parties receive a copy of this document. By signing below both parties, breeder and purchaser, have agreed to this Lifetime Genetic Health Guarantee and understand the terms and conditions of the contract
